My father died and left me a parcel of land with a cell tower. The lease expires in two years. After the lessee was informed of my father's demise, they hold the rent payment and made a contract amendment which I signed so that the rent payment could be released. The lease is ten years and this is their second lease. When they first leased the land they gave my father two million pesos as a goodwill. The rent escalates at five percent every year. When the first lease contract expired they renew the lease but the rent payment is the same as when they started on the first month of their first contract ten years ago. Can I call for a new lease negotiation when the lease expires in two years even though I have not yet transferred the land title in my name ? Am I entitled to a goodwill?
Not familiar with cell towers in Philippines by: Stephen
We are not familiar with how things work in your country. If you inherited the land, then the lease should transfer over to you. You should provide documentation to the tower company that you now control the land, and they should be dealing directly with you.
