Burnaby residential cell phone rental lease rates

We were approached by Mobilcity to ask our permission to use our residential building for telecommunications antenna.

How much should be be compensated for use of our common property?

What about risk of structural, engineering, electrical, mechanical, etc. damage to our building if a lightning hits their antenna? What should we do to protect ourselves and make them 100% responsible for all and related damages from installing the antenna in the first place?

What would happen to our building's and home owner's insurance once the equipment is put in place?

What happens to property values for those that have antennas before and after they are installed?

These are important concerns.

1. What would happen to our property values after the telecom equipment is installed?

2. How would this affect our strata fees (up or down)? Special levies? What about our assessments?

3. What happens if there was damage caused by telecom and related equipment and what is their scope of liability?

4. Building & owner’s insurance premiums. May rise because it was not part of building design & covered by strata fees?

5. How would we know that their lease offer to us is at fair value?

6. Is our building’s engineering for which it was designed (residential dwelling) enough to protect residents living near the equipment? Should we ask for a copy of the engineering analysis to state that our building is protected enough?

7. Is their offer of $1,000 for legal fees enough? The average billing rate starts at $200+ (excluding taxes). This will disappear even before the lawyer even looks at it in detail.

8. Are we bound to follow their proposal even though we don’t have contract agreement specifics? In other words, do we have a "point of no return"?

Lots of questions...

It sounds like your building is a condominium complex.

Compensation for a candidate building is based in part on location (including building height, and size and number of anttenna. Other factors include potential traffic, proximaity to a fibre tie-in, and access to power.

Risk (or the assignement of risk) can be determined by looking at the indemnifiction and insurance clauses of the agreement.

The impact of of a roof-top antenna on the value of a property can be positive from an income point of view. Any potential negative impacts could be addressed by the location and method of installation.
